1) Acceptance of Terms

These Terms and Conditions (“Terms”) form a binding agreement between you and BDS Web Hosting (“Company”, “we”, “us”, or “our”). By creating an account, purchasing, or using any Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy (available on request or on our website).

2) Definitions

• Services: Hosting, domain registration, email hosting, and related support we provide.
• Website: Any site or portal operated by BDS Web Hosting.
• Customer Content: Data, files, websites, and material you upload or host using our Services.
• Plan: A specific package of resources/features (e.g., storage, bandwidth) you subscribe to.

3) Services We Provide

We provide, among other things:

• Domain registration and DNS management;
• Shared and other web hosting solutions;
• Email hosting and related tools;
• Technical support.

We may add, change, or discontinue Services at any time to improve reliability, security, or performance.

4) Account Registration & Eligibility

• You must provide accurate, complete information and keep it updated.
• You must be legally capable of entering a binding contract.
• Accounts are non-transferable without our written consent.

5) Acceptable Use Policy (AUP)

You agree to use the Services lawfully and responsibly. Prohibited activities include (without limitation):

• Hosting or distributing malware, phishing, spam, or engaging in fraudulent, deceptive, or illegal activities;
• Infringing third-party intellectual property or privacy rights;
• Publishing unlawful, abusive, or harmful content, including content that violates applicable laws of Bangladesh or your local jurisdiction;
• Interfering with network integrity or security, excessive resource consumption beyond your Plan’s fair use, or attempting unauthorized access to systems.

We may, at our discretion, remove content or suspend Services to address AUP violations.

6) Domain Registration & DNS

• Domain registrations, transfers, and renewals are subject to applicable registry policies and terms.
• You are responsible for the accuracy of WHOIS/contact data and for timely renewals. Failure to renew may lead to loss of the domain.
• Domain fees are generally non-refundable once processed by the registry.
• DNS propagation times and third-party registry actions are outside our control.

7) Billing, Renewal & Taxes

• Fees are due in advance of the Service term unless stated otherwise.
• Late or failed payments may result in suspension or cancellation of Services and/or data removal.
• Prices are subject to change; we will provide notice of any changes applicable to your next term.
• Taxes, duties, and government charges (if any) are your responsibility.

8) Cancellations, Refunds & Trial Terms

Refund eligibility (if offered) depends on your specific Plan and any plan-level policy published on our website or provided at purchase. Unless stated otherwise in such policy:

• Setup fees, domain registrations/transfers/renewals, and third-party license fees are non-refundable.
• Pro-rata or partial-term refunds are not guaranteed.
• To request a cancellation or refund review, contact support@bdswebhosting.com.

9) Service Availability, Uptime & Maintenance

We strive for 24/7 availability. However, downtime may occur due to maintenance, upgrades, network issues, force majeure, or factors beyond our control. We may schedule maintenance windows and will endeavor to minimize disruption.

10) Backups & Data Protection

• While we may implement routine backups for disaster recovery, you are responsible for maintaining your own independent backups of Customer Content.
• We are not liable for data loss, corruption, or restoration delays.
• Security best practices (strong passwords, 2FA where available, updated applications) remain your responsibility.

11) Security & Account Credentials

• Keep your credentials confidential and unique; promptly notify us of any suspected compromise.
• You are responsible for actions taken through your account, whether authorized by you or not.

12) Third-Party Services

Some features may integrate third-party tools or services. Your use of such tools is subject to the third party’s terms and policies. We are not responsible for third-party actions or changes.

13) Intellectual Property & Content

• Our websites, designs, logos, and proprietary technology are owned by BDS Web Hosting and protected by applicable laws.
• You retain ownership of your Customer Content. By using the Services, you grant us a limited license to host, copy, and transmit your content solely to provide the Services.
• If you believe material hosted via our Services infringes your rights, contact us with sufficient detail for review and response.

14) Disclaimers & Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

15) Limitation of Liability

To the fullest extent permitted by law, BDS Web Hosting shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or use, even if advised of the possibility of such damages. Our aggregate liability for any claim relating to the Services shall not exceed the amount you paid to us for the Service giving rise to the claim during the three (3) months preceding the event.

16) Suspension & Termination

• We may suspend or terminate Services (with or without notice) for AUP violations, non-payment, security risks, or legal requests.
• Upon termination, your right to use the Services ceases; we may delete data associated with your account in accordance with our policies and applicable law.

17) Changes to These Terms

We may update these Terms to reflect changes in our Services or legal requirements. We will indicate the effective date at the top of this page. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

18) Governing Law & Dispute Resolution

These Terms are governed by the laws of Bangladesh. You agree to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh to resolve any dispute arising from or relating to these Terms or the Services.
